1.1. Who is responsible for the processing of your personal data?

AGROPECUARIA MARTEÑA, S.A is RESPONSIBLE for the processing of the USER's personal data and informs you that this data will be processed in accordance with the provisions of Regulation (EU) 2016/679, of 27 April (GDPR), and Organic Law 3/2018, of 5 December (LOPDGDD).

2. Purpose and basis of the processing and the nature of the Data provided.

AGROPECUARIA MARTEÑA, S.A. will at all times process the Data for the specific purpose of the service that the Client has contracted or requested information on and will only process those Data that are relevant to the achievement of said purpose. Specifically, AGROPECUARIA MARTEÑA, S.A. will process the Data according to the basis and purposes indicated below:

2.1. For the performance of contractual obligations (Art. 6.1.b of the GDPR).

The Data are processed to provide the requested service to its Customers; to manage the business relationship with them and to ensure the proper provision of services, for example, sending service-related queries to the Customer or issuing invoices. The purposes of the Data processing are directly related to the contracted service.

2.2 For legitimate interest of the data controller (art. 6.1. f of the GDPR).

Where appropriate and without unduly affecting the privacy interests or fundamental rights and freedoms of Customers, AGROPECUARIA MARTEÑA, S.A. will process the Data, in addition to the effective performance of the contract, in order to satisfy legitimate interests pursued directly by AGROPECUARIA MARTEÑA, S.A. or by a third party . These legitimate interests may include:

          • Provide services including the issuance of the report if applicable and subsequent copies.
          • Sending commercial advertising communications by e-mail, fax, SMS, MMS, social networks or any other electronic or physical means, present or future, that enable commercial communications. These communications will be made by the RESPONSIBLE and will be related to its products and services, or those of its collaborators or suppliers, with whom it has reached a promotional agreement. In this case, third parties will never have access to personal data.
          • Conduct market research and statistical analysis.
          • Evaluate claims and exercise the defense.
          • To guarantee the infrastructure and the IT security environment of AGROPECUARIA MARTEÑA, S.A.
          • Carry out risk management and regulatory compliance tasks.
          • Process orders, requests, respond to queries or any type of request made by the USER through any of the forms of contact that are made available on the RESPONSIBLE's website.
          • To send the online newsletter about news, offers and promotions in our activity.

2.3 As a consequence of your consent (Art. 6.1. a GDPR).

As long as you have given us your consent to process the Data for specific purposes, such as your participation in sweepstakes or promotions promoted by AGROPECUARIA MARTEÑA, S.A. this treatment will be lawful by virtue of such consent. Your consent is always optional and can be withdrawn at any time. For clarification purposes, the withdrawal of consent will not affect the lawfulness of the processing of data that has been carried out prior to such withdrawal.

Due to legal provisions (Art. 6.1.c of the GDPR) or in the public interest (Art. 6.1.e of the GDPR).

We are also subject to certain legal obligations, i.e. legal and regulatory provisions, such as the submission of requested data to the relevant administration. The purposes of the processing include the fulfillment of control and reporting obligations under tax legislation or, in certain cases, due to mandatory accreditation, training and/or certification requirements.

In cases where the collection of Data is carried out to fulfill legal or regulatory obligations of AGROPECUARIA MARTEÑA, S.A., to enter into a contract with its Clients or is necessary for legitimate purposes, if AGROPECUARIA MARTEÑA, S.A. is unable to collect such personal data, we cannot undertake to provide the agreed services and, therefore, fulfill the contractual obligations (in which case you will be duly informed).

2.5. Who has access to the Data and with whom it is shared.

Data can be communicated:

To provide our services to our customers and ensure a constant level of service.

          • To third parties who need to carry out specific activities in relation to the Data according to the purposes of the processing, or to suppliers who provide services to AGROPECUARIA MARTEÑA, S.A. such as suppliers and subcontractors of information technology and hosting services, marketing providers, debt collection companies or subcontractors. In such cases, we take measures to ensure that our standards with respect to data security are met, so that the Data provided remains secure.
          • To authorities, entities and/or subjects to whom the Data must be communicated in accordance with mandatory legal or contractual provisions. Such authorities, entities, clients and/or data subjects shall act as independent data controllers.

3. Categories and types of Data we collect and process.

- Contact information provided by the Customer (such as name, address, phone number, e-mail addresses)

- Financial details (identification of tax numbers, financial transaction data, credit or debit card information and bank account details).

- Electronic identification data such as cookies and IP addresses;

- Any other personal data in the framework of our business relationship with the Customer and as determined in the specific contractual terms.

3.1. How long will we keep your personal data?

They will be kept on paper and/or electronic media for no longer than necessary to maintain the purpose of the processing or there are legal prescriptions dictating their custody in accordance with the principles of necessity, minimization and adequacy and when no longer necessary for this purpose, they will be deleted with appropriate security measures to ensure the anonymization of the data or the total destruction of the data, respecting the principles of limitation of the retention period and minimization of data referred to in art. 5.1, paragraphs c) and e) of the GDPR.

AGROPECUARIA MARTEÑA, S.A. may keep the Data after the termination of the contractual relationship in order to comply with regulatory, contractual and/or fiscal obligations or in case of legal claims. Subsequently, when the aforementioned reasons for processing cease to exist, the Data will be anonymized, deleted or destroyed.

4. What are your rights?

Any data subject may exercise the rights referred to in Articles 15 to 22 of the GDPR, which are set out below, by sending a request through any of the above-mentioned contact channels:

The rights of the USER are:

    • Access: you can obtain information regarding the processing of your Data and a copy of it.
    • Deletion: you may request the deletion of your Data, to the extent permitted by law.
    • Opposition: you can oppose the processing of your Data, for reasons related to your particular situation. In case of opposition to the processing of Data under art. 21 of the GDPR, AGROPECUARIA MARTEÑA, S.A. reserves the right to evaluate your request, which will not be accepted if there are legitimate reasons to proceed with the processing that prevail over your freedoms, interests and rights.
    • Rectification: in the event that you believe that your Data is inaccurate or incomplete, you may request that it be modified as appropriate.
    • Limitation: you can request the limitation of the processing of your Data.
    • Withdrawal of consent: if you have given your consent to the processing of your Personal Data, you have the right to withdraw it at any time.
    • Data portability: if legally appropriate, you have the right to have the Data you have provided to us returned to you or transferred to a third party where technically possible.
    • The right to lodge a complaint with the supervisory authority (www.aepd.es) if you consider that the processing does not comply with the regulations in force, as provided for in art. 77 of the GDPR.

5. International Data Transfer

AGROPECUARIA MARTEÑA, S.A. does not carry out international data transfers outside the European Economic Area (EEA) for the provision of services. In case of international data transfer, we guarantee the adoption of measures to protect them before the transfer.

Any transfer of the Data to international organizations and/or countries outside the European Economic Area (EEA) will be carried out in accordance with one of the methods permitted by applicable law.

6. SECURITY MEASURES

That in accordance with the provisions of the regulations in force on personal data protection, the RESPONSIBLE is complying with all the provisions of the GDPR and LOPDGDD regulations for the processing of personal data under its responsibility, and manifestly with the principles described in Article 5 of the GDPR, whereby they are processed lawfully, fairly and transparently in relation to the data subject and are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

AGROPECUARIA MARTEÑA, S.A. guarantees that it has implemented appropriate technical and organizational policies to apply the security measures established by the GDPR and the LOPDGDD for the protection of data against accidental, unlawful or unauthorized destruction, loss, alteration, misuse, communication or access, as well as against other unlawful forms of processing. These security measures have been implemented taking into account the state of the art, their cost of implementation, the risks involved in the processing and the nature of the personal data, with particular caution in the case of special categories of data. In particular, there is adequate awareness, training and commitment to confidentiality to ensure that the Data is not shared or communicated to unauthorized persons in order to protect the rights and freedoms of USERS and has communicated to them adequate information to enable them to exercise them.

7. Status and update of privacy policy

This privacy policy has been updated on 08/29/2023. AGROPECUARIA MARTEÑA, S.A. reserves the right to modify it when deemed appropriate. If the privacy policy has been updated, AGROPECUARIA MARTEÑA, S.A. will take the appropriate measures to inform its Clients of the update through the appropriate means.

8. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

USERS, by checking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form or presented in download forms, expressly and freely and unequivocally accept that their data are necessary to fulfill their request, by the provider, being voluntary the inclusion of data in the remaining fields. The USER guarantees that the personal data provided to the RESPONSIBLE are truthful and is responsible for communicating any changes to these.

The RESPONSIBLE informs that all data requested through the website are mandatory, as they are necessary for the provision of optimal service to the USER. In the event that all the data is not provided, there is no guarantee that the information and services provided will be completely tailored to your needs.

1. USER INFORMATION

Who is responsible for the processing of your personal data?

AGROPECUARIA MARTEÑA, S.A hereinafter RESPONSIBLE, informs the USER that it has proceeded to create profiles on the Social Networks Facebook, Instagram, Twitter, LinkedIn, YouTube, or any other social network, which is responsible for the processing of personal data of the user that is carried out in these social networks and informs you that these data will be treated in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR), and the Organic Law 3/2018 of 5 December (LOPDGDD), so it is provided the following treatment information:

What do we process your personal data for?

Purpose of processing: to maintain a relationship between the USER and the RESPONSIBLE which may include the following operations:

  • Handling requests and queries to the person in charge
  • Report on activities and events organized by the person in charge
  • To inform about products or services offered by the responsible party.
  • Interact through official profiles

Why may we process your personal data?

Legal basis for the processing: Article 6.1.a GDPR, the data subject has consented to the processing of his/her personal data for one or more specific purposes. The USER has a profile on the same social network and has decided to join the social network of the RESPONSIBLE thus showing interest in the information published therein, therefore, at the time of requesting to follow our official profiles, he/she gives us his/her consent to the processing of those personal data published on his/her profile.

The USER can access at any time to the privacy policies of the social network itself, as well as configure your profile to ensure your privacy.

The RESPONSIBLE has access to and processes the USER's public information, in particular the USER's contact name. These data are only used within the social network itself and will only be incorporated into a file of the RESPONSIBLE when necessary to process the USER's request.

How long will we keep your personal data?

Data retention criteria: data will be retained as long as the USER does not revoke the consent given as indicated in this privacy policy.

To whom do we provide your personal data?

Communication of data: the information provided by the USER through the social networks of the RESPONSIBLE, including their personal data, may be published, always depending on the services that the USER uses, so it may be publicly available to other third party users of social networks. From the profile of each social network, the USER can configure what information he/she wants to make public in each case, see the permissions that have been granted, delete them or disable them, such as any third party application that is no longer desired to be used.

No communication of personal data to third parties outside the social network is foreseen except, if essential for the development and execution of the purposes of the processing, to our service providers related to communications, with whom the RESPONSIBLE has signed confidentiality and data processor contracts required by current privacy regulations.

What are your rights?

Rights of the USER: may only be exercised in relation to information under the control of the RESPONSIBLE.

  • Right to withdraw consent at any time
  • Right of access, rectification, portability and deletion of your data, and of limitation or opposition to its processing.
  • The right to file a complaint with the supervisory authority (www.aepd.es) if you consider that the processing does not comply with the regulations in force.

2. USE OF THE PROFILE

The RESPONSIBLE will perform the following actions:

  • Access to public profile information
  • Publication on the USER's profile of all information already published on the RESPONSIBLE person's social network.
  • Send personal and individual messages through the social network channels
  • Page status updates that will be posted on the USER's profile.

The USER can always control their connections, delete content that is no longer of interest to them and restrict who they share their connections with by accessing their privacy settings.

2.1. PUBLICATIONS

The USER, once he/she is a follower or has joined the RESPONSIBLE's social network, may publish comments, links, images, photographs or any other type of multimedia content supported by the same. The USER, in all cases, must be the owner of the content published, enjoy the copyright and intellectual property rights or have the consent of the third parties concerned.

Any publication on the social network, whether text, graphics, photographs, videos, etc. that violate or are likely to violate morals, ethics, good taste or decorum, and/or that infringe, violate or violate intellectual or industrial property rights, the right to image or the law, is expressly prohibited.

In these cases, the RESPONSIBLE reserves the right to immediately remove the content, without prior notice, and may request the permanent blocking of the USER.

The RESPONSIBLE PARTY shall not be held responsible for the contents freely published by a USER.

The USER must keep in mind that his/her publications will be known by other users, so he/she is the main responsible for his/her privacy.

The images that may be published on the social network will not be stored in any file by the RESPONSIBLE, but they will remain on the social network.

3. OUR WEBSITE MAY USE BUTTONS FOR THE FOLLOWING SOCIAL NETWORKS

The buttons display the logos of the individual social networks. However, the buttons are not standard social plug-ins, i.e. plug-ins provided by social networks, but links with button icons. These buttons are only activated by deliberate actions (clicking). As long as you do not click on the buttons, no data will be transferred to the social networks. By clicking on the buttons, you agree to communication with the social network servers, activating the buttons and establishing the link.

Once clicked, the button functions as a sharing plug-in. The social network then retrieves information about the site you have visited, which you can share with your friends and contacts. 4. DATA OF MINORS OR PEOPLE WITH SPECIAL ABILITIES

Access and registration through the RESPONSIBLE's social networks is prohibited to minors under 18 years of age. On the other hand, if the USER has special abilities, it will be necessary the intervention of the holder of his parental authority or guardianship, or his legal representative by means of a valid document proving the representation.

 

The RESPONSIBLE shall be expressly exonerated from any liability that may arise from the use of social networks by minors or people with special abilities. The RESPONSIBLE's social networks do not knowingly collect any personal information from minors, therefore, if the USER is a minor, he/she should not register, use the RESPONSIBLE's social networks or provide any personal information.
